A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in immigration custody.

In her order, the judge pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
